Stacey Barker August 11 Hearing - Star Witness Doesn't Want To Play

The murder case against Stacey Barker finally appears to be nearing the trial phase of the legal process. At a hearing held at  the Michael Antonovich Antelope Valley Courthouse in Lancaster, CA.on August 11,  Superior Court Judge Hayden Zackey said the court is still shooting for a trial the week of September 26, 2010.

 At a previous hearing Judge Zacky required the prosecution and the defense to agree if they want him to preside over this trial the only excuse for it not happening in September is if his schedule has a conflict.

Stacey Barker is a 25 year old woman from Lancaster, CA accused of suffocating her 18 month old daughter, Emma Leigh Barker, to death before dumping Emma's body in tall grass on the side of the freeway on March 18, 2009.

When Emma was first reported missing, Stacey Barker claimed Emma had been kidnapped. Barker claimed she had been knocked out by "the kidnapper" as she loaded her daughter into her car seat when they were leaving playtime at a local park. Barker claimed the next thing she knew she came to six hours later in her car, now parked several miles away in a Palmdale park and ride lot, partially unclothed, injured and her daughter was missing. Because Barker did have injuries consistent with a struggle she was transported to the hospital for treatment and an Amber Alert was issued for Emma.The next day Barker admitted making up the abduction story and led authorities to Emma's body. She said the little girl died accidentally, causing her to panic (afraid she would be blamed) and leave the girl's body near the freeway.
  
On April 27,2009, Barker was arrested and the charges filed against the young mother include murder, assault on a child causing death and child abuse. Stacey Barker formally entered a not guilty plea to all counts on August 12, 2009. She has since been held at the Century Regional Detention Facility in the city of Lynwood on $1 million bond
.
The purpose of this article is to share the details of the hearing on August 11. Once again, Tori, and friends have taken time out of their day to attend the hearing and share the details with us. ~ thank you ladies ~
The hearing got started early, around 9 a.m.. Deputy District Attorney Kelly Cromer was first in the courtroom today, followed by Public Defender Roberto Dager. When Judge Zackey came in, court got under way even though the defendant wasn't in the courtroom yet.

At the July 26 hearing, PD Dager had requested an inmate named Erin Sutton, who was communicating with defendant Barker, be brought into court to answer some questions. PD Dager told the court that Erin Sutton is or claims to be a GOVERNMENT AGENT! Judge Zacky asked, "Do you mean a government informant? Dager said," NO, on one of the taped conversations with my client he identifies himself as a Government Agent. An employee of the state." Dager wants him in court to answer questions about other cases he has testified in and so forth...under oath and the hearing was scheduled for August 11.

We overheard someone say something like "HE" is refusing to talk or that "HE" should refuse to talk...something along those lines, it was hard to hear.(.Apparently the "star witness" for the day didn't want any part of these proceedings.) Shortly after, the Bailiff informed the court, "He" is here" (in holding cell). Judge Zacky and the Bailiff exchanged a few words before the Judge called PD Dager, DDA Kelly Cromer and the Court Reporter with her steno machine to his chambers.
 (We speculate that Erin Sutton was brought into Judge's Chambers to answer Dager's questions in private. We were disappointed at not being able to hear Sutton's testimony; but, unless it is sealed we will find out eventually, especially if the state uses any of the communication between Sutton and Barker at trial.)

 I should add that  Mr. Dager told the court this information about Sutton, on the record, on July 26. While we normally report anything that is on the record, we felt we should wait to disclose this until after this hearing. If Erin Sutton has incriminating testimony against Ms. Barker, you can be sure the defense will try everything they can to discredit him. Frankly just the fact Sutton  is a convicted criminal gives the defense a leg up, especially if he is benefited for testifying.....that is....unless Barker was recorded saying or wrote something to incriminate herself

An Aunt of Stacey Barker commented at the Now Public forum., evidently in reply to our question, "Why would Stacey Barker associate herself with such a guy as Erin Sutton aka Vampire?"
This is a quote of one of her comments, "The answer to your question is Sutton was a plant by the DA on the bus.  The intent was to extract some sort of information regarding Emma's death.  He was convicted and sentenced to 26 years, for some sort of child molestation.  He was offered a deal (and was found guilty bgy[sic] his peers of his crime) to get a lesser sentence if he befriended Stacey.  So there you have it.  Let's talk about the DA making a deal like that to cover her week[sic] case on Stacey." She added this in another comment,"The DA has nothing on Stacey, that's why they offered a convicted person like Aaron to try and get evidence and it turns up nill[sic]!  But he gets 18 years off of his sentence??? There's justice at work."

 I supplied the link to her comments and our replies at the NP forum above, if you are interested. I do want to say that as far as we can find (Tori contacted the Superior Court phone line for inmate information) Erin Sutton is in jail for felony robbery not child molestation and he is not on any of the state sex offender registries that we could find. We don't know if Sutton is an "informant" or "government agent" but can pretty comfortably say it sounds far fetched to give someone an 18 year reduction in a 26 year sentence for "just trying" to solicit information. I don't know who gave them this information, we'll have to wait and see if it's correct or not. Granted, as family of the accused,  they are in a very frustrating position and we have no desire to argue with them. We have a right to follow this case, form our own opinions and share what we hear in court with you. What matters at the end of the day is what the jury of Stacey Barker's peers decide after they have heard the evidence that is allowed into court.

OK back to the hearing:

Dager, Cromer, the Judge and the Court Reporter came back,. Zacky said the next hearing will be on August 26  for wrap up of discovery. Judge Zackey then  instructed the Bailiff to bring Ms.Barker in please...
When SB came in today, she appeared to be in a snit, walking heavy and mad looking. She didn't look into the gallery at all, she plopped down into the chair next to PD Dager and faced forward.
Zacky advised Barker we are still shooting for the week of Sept 26th for trial. We'll  be back here August 26 to discuss the motions you want filed (or have filed ?) specifically mentioning some previously filed motions:

1) MOTION FOR CHANGE OF VENUE - This motion was filed on January 17. When Judge Zacky denied the motion for COV on February 18, he told the defense we have a large jury pool and we won't know until we poll the jurors if that is necessary. {Meaning  it was denied without prejudice, so it could be brought up again later. )

2) EXCLUSION OF MEDIA - After filing  the change of venue motion  on January 17, PD Dager informed the court if his motion for COV was denied,  he would ask that all media and news reporters and people in the gallery that report on this case on blogs be kept out of the courtroom.
Judge Z said he would have to do some research on this, because of the "Freedom Of Information Act", the community has the right to know what is going on.

Judge Zacky continued," ALL the other motions you want to file at that time will be heard", and then asked," You will be bringing in expert witnesses right?" The judge reminded both sides," We will finish up any discovery either side may have." adding, "Discovery is a ongoing thing."

DDA Cromer said, " Here are some more letters and phone calls" as she handed a giant yellow envelope to PD Dager, which he sort of  let  fall on the table hard, he didn't seem pleased with this new stuff.

Judge Zacky said, "OK, We will see you all back here on the 26th and court was recessed." Stacey Barker got up and escorted by the bailiff she marched off towards the holding cell as if she was mad, at the last second she tried to turn and mouth "I love you" but none of her intended recipients were looking at her, as her boyfriend and grandparents, who attend every hearing, had already left their seats and had their backs to her when she decided to acknowledge them....so no one saw her this time.

Dear Readers...Please Bear With Me

Dear Readers,
Because of personal issues I am way behind in my blogging.
Mr. Katfish was very sick and in the hospital most of last week. Shortly before he got sick, I fell on my stairs and bunged up my knee. Mr. Katfish is home and feeling much better so my time is my own again; however, I'm still dealing with pain and I'm pretty much immobilized right now. I'm going to try and sit at the computer as long as I can. Please Stick With Me.....I am working on the following posts:

I have also come across another Missing Adult Case, of  Zachery Pittman, a 26 year old Louisiana man, that isn't getting the media coverage or the police investigation that it deserves. I really want to help Zach's mom get the word out, so please keep an eye out for an upcoming post on Zach. It's a no brainer that most  missing cases involving children get attention, although you might be surprised the number that don't. If a missing persons case involves a young pretty woman (particularly white) it will likely garner media coverage.....but beware if you have a son or brother in the 20-40 age range and they go missing,  the issue isn't just media coverage but also getting law enforcement to investigate. I don't mean to disparage LE in any way. I have learned that until the media gets involved there may not be much resources expended for young men gone missing, it's just a fact of life.

I may not get the posts done in the order they are listed here, but hopefully they will be worth the wait.
I have noticed from my blogroll there  has been a lot going on in the Casey Anthony and the Haleigh Cummings cases but I want to complete the stories that I have already started drafts in my blogger. So in conclusion here, thank you for visiting katfish....ponders. I can't tell you how much I enjoy blogging and strive to give you the most accurate and complete information I can.

Haleigh Cummings Reminder - A Vigil And Her Birthday

Haleigh Cummings was 5 years old when she was reported missing from her home in Satsuma Florida at about 3:30 in the morning on February 10, 2009 by her father, Ronald Cummings and his live-in girlfriend, Misty Croslin..
 
Despite the fact that within 1 hour of Haleigh being reported missing, the FL Department of Law Enforcement activated the Child Abduction Regional Team and searching began by over 100 officers from county, state and federal law enforcement by helicopters, bloodhounds, ATV riders and ground searchers conducted grid searches of the wooded area while boats and divers searched the nearby St. Johns River, there has been no sign of Haleigh and apparently no evidence to indicate who may be responsible for her disappearance.

While there has been no arrests directly related to Haleigh's disappearance, the Putnum County Sheriff's Office (PCSO) did say early on they didn't think this was a stranger abduction case. On April 15, 2010, Sheriff Jeff Hardy, of the PCSO, announced the investigation is now classified as a homicide investigation.

I realize I've been very brief in the introduction of this article. The main purpose of this article is to remind everyone that Haleigh is still missing and to give a heads-up to some upcoming events for Haleigh, which I'll get to in just a minute. Secondly, Katfish...ponders wants to commend Simon and Jan Barrett of The Blogger News Network (BNN) for keeping this story "alive" in the media over the past year and a half. BNN has consistently contributed their resources to this case, including doing  a radio show about this case on Blog Talk Radio every Sunday at 4pm Eastern. On a recent stop over to BNN, I noticed Jan had written another article about Haleigh, and I want to take the opportunity to help spread the word.....

Jan Barrett wrote, " The Cummings family has decided to hold a vigil to commemorate Haleigh being gone which will be held in Welaka, Florida. The memorial is set to take place at the First Baptist Church on Tuesday, Aug, 10th at 6:30 pm."
Jan also wrote, "They have also arranged for a balloon release to take place on Haleigh’s birthday, August 17th. Since Haleigh was born at 2:16 am they have decided to release the balloons at precisely 2:16 pm that day. The family will be providing the balloons and the release is scheduled to be at the Riverfront Park next to the clock tower."

On Tuesday, August 10, 2010  Haleigh will have been missing exactly 18 months. And then Tuesday, August 17 will be Haleigh's 7th birthday (if she is indeed still with us). I just attended one of my niece's 7th birthday in July, the kids had fun swimming, her parents rented a jump room and all the kids at her party jumped and jumped and jumped some more. They played pin the tail on the donkey and broke a pinata. If Haleigh is still with us I pray that someone makes sure she has a fun day. If she is no longer with us, well.... no doubt she is leading all of  the other angels cloud dancing everyday so this will be just another glorious day in Gods loving arms.

I realize many people who have taken an interest in this case won't be able to attend the activities her family has planned, most likely because of distance, but please honor Haleigh by thinking of her....maybe light a candle and say a prayer for Haleigh and both sides of her family who love her and must miss her so......Crystal Sheffield is Haleigh's mother. I haven't heard of any events organized by Crystal's family but would be happy to include those plans as well.

A regular commenter over at BNN named "J." made the following comment the other day.......

I released red and purple balloons last year for Haleigh’s sixth birthday with fliers in them. This year, I will release red and purple balloons (her favorite colors) to “celebrate” her birthday.
There is an email address that people can email pictures into if you do your own balloon releases and the pictures will be shared online.
balloonsforhaleigh@gmail.com I pray so hard for Haleigh and her loved ones. A year and half with no answers is just brutal. I don’t know how they all do it. They all need answers and Haleigh needs to come home (one way or another), preferably ALIVE. Oh how I pray for that!"

Thanks for sharing that wonderful idea "J". Both sides of Haleigh’s family have been trashed on the internet,and unfortunately  because of their behavior “some” may deserve it. Regardless of any of their behavior, they are the people Haleigh loved and they are still missing their little Haleigh Bug. I think the link to submit pictures is a wonderful way to express support to them all.

There has been concern expressed about the effect of a balloon launch on the environment as well as some communities having laws against balloon launches. If you find there is a law against launching balloons in your area or if you live in an area where there may be a concern for sea life mistaking a balloon for food, a picture sent lighting a candle would be a thoughtful gesture. I did a little research and want to share this information:

Brief summary-
*As long as latex balloons are used they are biodegradable.
*Limit your balloon release to 10 or fewer balloons.
*Use only hand-tied latex balloons and no plastic attachments or strings.
*Never release metallic balloons.
*Never attach metallic ribbon to helium-filled balloons. Metallic ribbon and balloons conduct electricity and may come in contact with power lines when released.
*Always use fully inflated balloons, and release shortly after filling.
* Instead of inserting a flyer inside the balloon (launch issues) perhaps just write a note with a marker on the balloon.
The bottom line is, This is really all about the thought of this sweet little girl and if you take the time to e-mail a picture it is without a doubt an act of compassion for our fellow man.

I think it’s a fair assumption to say that anyone  who has followed this case, has turned the case inside out numerous times and came up with hundreds of theories about what happened to Haleigh, but there just doesn’t seem to be any concrete evidence to support any theory. For reasons that have not been disclosed to the public, Law Enforcement has declared this a homicide investigation. I admit that the only theory I have left standing in my mind is that Haleigh is already in Heaven. I won't go into my theory unless someone asks, but I can honestly say  I have never so wanted to be wrong about something. In all fairness to Haleigh as long as there is no evidence to show me otherwise I will continue to have that flicker of hope for her safety. At the time she went missing Haleigh Cummings was described as three feet tall, 39 pounds, with blonde hair and brown eyes. Haleigh has Turner's syndrome so she likely is still of short stature for her age. Other physical features of Turners Syndrome include:
  • A short neck with a webbed appearance
  • A low hairline at the back of the neck
  • Low-set ears.
Haleigh also has a birthmark on her left cheek shaped like a peanut. You can see the birthmark in this picture.
Please keep in mind it is possible that efforts have been made to disguise Haleigh's appearance.

The Mysterious Disappearance Of Eric Preimesberger

 The name Eric Preimesberger first came to the attention of Katfish....ponders because I was seeing Google and Yahoo searches for an Eric Preimesberger on my statcounter. I think the reason these search engines were referencing Katfish....ponders in relation to searches for Eric was because I have  The Hinky Meter listed on my blogroll. I don't really know Valhall, owner of The Hinky Meter but I put her on my blogroll because she has a background in science and does a good job of deciphering the forensic evidence that comes up in various crime cases I follow. She also covers other aspects of the cases she writes about in an analytical way and I like that. I didn't make the connection why I was getting these " search hits" until the other day when I stopped by The Hinky Meter to read about another case and noticed a recent post  by Valhall about Eric's disappearance titled, " Eric Preimesberger: A continuing look at this mysterious case."  For an in-depth look at this case I suggest you follow the above link to this post  that includes links to the other reports Valhall has written about this case. Family members of Eric and Kristi have been commenting at The Hinky Meter as well.

I'll try give you my take on this case as briefly as possible, as well as links to the few media outlets that have carried the story. The mainstream media has been slow in picking up this story. The Hinky Meter has done a great job of assisting the family in getting their story out. Hopefully by covering the case here, we can assist in finding Eric and his family.

This is indeed a strange case, Eric Preimesberger, his wife Kristi and their two children, daughter Ivy, 6 yrs and son Damion, 20 months, were planning a move from Reno, NV to Eugene, OR on April 30, 2010. According to what Eric told his family, the purpose of the move was for Eric and Kristi's brother, Tim Morgan, to start a new business building Yurts.

Eric's mother, Kay, called Eric and Kristi's home in Reno, NV on April 20th because it was the couple's 7th wedding anniversary. Kay says that she spoke to Eric and he was excited about the upcoming move and the prospect of the new business.....little did Kay know that this would be the last time she would speak to her son.

Kay says she called the next day to wish Kristi a happy anniversary as well, because Kristi had been out  when she called the day before. Kay said when Kristi answered she blew off the anniversary wishes, said Eric isn't here and hung up. Over the next 3 days family members of Eric attempted to contact him but were told for various reasons he couldn't or wouldn't talk. Finally, on the 24th Kristi confided to one of them that Eric had became angry, thrown his cell phone at her along with the keys to his beloved Ruckas scooter, and left on foot telling Kristi that she would never see him again. Family members have expressed doubt that Eric would leave on foot, he has a bad back and an injured ankle....plus he LOVES his Ruckas. Why leave it? I won't go into Kristi’s stories concerning the last time she saw Eric, but reports are they were suspicious and changing.

 Despite efforts to get Kristi to file a missing person's report, she refused. On May 3 Kristi packed up a Pod with all their belongings, took Ivy (removed from school early) and Damion and  moved with the help of her brother Tim to his house in Eugene, OR. I should note that both Eric and Kristi are originally from NM and that is where both of their Mothers still live.

Both Eric and Kristi's family concede their marriage has been a stormy one, but his family and friends insist he would not just walk out on his children and cut off all contact with his family and friends.After 3 weeks of noone hearing from Eric, his mother was able to file a missing person report with the Reno, NV Police.

This case has been declared a suspicious disappearance and  has been transferred to the robbery/homicide division of the Reno PD, which allows them more investigative options. Despite being the last person known to have seen Eric,  Kristi has not been named a suspect or a person of interest in Eric's disappearance; however,  Reno PD do tell Eric's family they would like to talk to her.
*Update 7/26 : It has been reported that Kristi is communicating with Detective Myers of Reno PD.

Here is where the story takes an even stranger turn.....when Kristi left Reno on May 3, she only stayed at her brother’s home for a few weeks.  A week before Memorial Day she arrived at the home of Eric’s stepsister in Vancouver, Washington.  Kristi had called Eric’s stepsister stating Eric was missing and she needed a place to stay.  She informed the stepsister(Eric's deceased father's step-daughter) that she could not go home to her mother, Karen, and that her brother was only able to put her and children up for a few weeks.  The stepsister invited her up. It should be noted that the stepsister and other relatives were made to believe, by Kristi, that both her mother, Karen, and Eric’s mother, Kay, knew she was staying in Vancouver and that she planned to do so for the entire summer.....this is not the case. Karen thought she was at Tim's place in Eugene and Kay had no idea where Kristi and the kids were because she wouldn't and isn't accepting Kay's calls.

Kristi left stepsister's home on June 16th, saying that she was headed to her mother’s home in New Mexico.  The stepsister and other relatives in the Vancouver area have tried repeatedly to contact Kristi since she left, but her cell phone goes immediately to voice mail. On July 6th the Sheriff’s department of Clark County, Washington contacted the stepsister and took her statement because, according to the Clark County Sheriff’s department the stepsister is the last person to have seen Kristi and the children. The Clark County Sheriff’s department states Kristi did not return to her brother’s home in Eugene, Oregon because Tim had already gone missing himself on June 14th.  The sheriff’s department confirmed that no one has physically seen Kristi, or the two children, since they left the stepsister’s home on June 16th.

 Kristi's mother says she received a phone call on July 2 from both Tim and Kristi, but she says she doesn't know where they are. Kristi told her mother the children are safe. In addition to needing to be returned to the Reno area to assist investigators in finding Eric, Kristi needs to be located for the protection of the two small children she has with her.Here are some pictures of Kristi, Tim and the kids:

Nicholas Sheley Defense Asks For Special Prosecutor

WGIL Radio in Galesburg, IL reports that the defense for Nicholas Sheley filed a motion on Monday, July 12 to have a special prosecutor appointed in his capital murder trial. I haven't seen the motion yet, so I'll supply the article from WGIL.com Their article will appear in black italics in this post and my analysis and opinions of the case will appear in regular type.

The local attorneys for accused spree killer Nicholas Sheley say a recent order in their favor makes it necessary for a special prosecutor to be appointed in the case.

Documents were filed Monday in Knox County Circuit Court by defense attorney Jeremy Karlin asking for the special prosecutor.

Karlin cites an order signed last month by Judge James Stewart that allows the defense to seek certain testing or services on an "ex parte" basis -- meaning, without prosecutors being present -- and also allows the Department of Corrections to transport Sheley for that testing without telling prosecutors.


On April 1, 2010, Judge James Stewart issued an order directing the Illinois Department of Corrections to transport defendant Nicholas T. Sheley for certain testing. The DOC filed an emergency motion  for leave to file a petition for an original writ of mandamus.The motion was denied and the order was entered by the court.


The IL Department of Corrections (IL DOC) then filed an emergency motion with the IL Supreme Court for a supervisory order. The motion was allowed. The Supreme Court wrote in it's order, " In the exercise of this Court's supervisory authority, the Circuit Court of Knox County is directed to vacate its order of April 1, 2010, directing the Illinois Department of Corrections to transport defendant Nicholas T. Sheley for certain testing. The circuit court is directed to conduct a hearing at which the Illinois Department of Corrections may be heard on the subjects of safety and expense, and may suggest alternative orders."


That hearing was held on June 18 and the court, again, ordered the DOC to transport the defendant for the required testing. Stewart told the defense whenever they need an ex parte hearing they should notify the prosecution of the hearing so they are aware, but the order allows Sheley to be tested and transported without the knowledge of the prosecution.

I wrote an entry on the June 18 hearing when
Judge James Stewart upheld this order titled 
"The Nicholas Sheley Case, 
It's A Long And Winding Road To Justice".

But Karlin claims while the order means his side doesn't have to disclose parts of their case prematurely, the filing says "A party to these orders has failed to comply with the terms of these orders."

Karlin doesn't specify in the filing who's at fault -- just that a special prosecutor is needed to help enforce ex parte matters in the future.

Because of the position the IL DOC has taken regarding this transport, Katfish...ponders feels comfortable speculating that the DOC in some way notified the state of a transport. They may have notified another agency within the executive branch of a transport feeling they would still be in compliance but the state was notified ??? I just don't see the State's Attorney or Illinois Attorney General's office failing to comply with the judge's order, besides, how would they know unless it came from the DOC?

But he's now also asking the judge to dismiss the entire 17 count indictment against Sheley, accusing him of bludgeoning to death 65-year old Ronald Randall among other things over two-years ago now -- part of a suspected two-state killing spree, and to strike a notice of intent to seek the death penalty.

We can consider these latest motions as 
just another curve in that road to justice.

This isn't the first time Sheley's defense has made a motion to dismiss the 17 count indictment or to have the option to seek the death penalty removed. Those motions were previously denied in 2009. It's not clear without having seen this latest motion to dismiss and strike if they are being presented as sanctions for failure to comply with the court's order or just a continuing attempt to provide Nicholas Sheley with a vigorous defense. I tend to think it's the latter.

The Illinois Attorney General's office has aided the Knox County State's Attorney in trying the case, but Karlin says appointing a special prosecutor means Sheley's right to a fair trial will be maintained.
 
Again, this is just my opinion based on what little I know and have speculated about these recent developments.....If the DOC feels they must notify someone about these transports for safety reasons, maybe it is appropriate to appoint a special prosecutor or special master to oversee these exparte matters.

Sheley is currently serving a prison sentence for starting a fight with employees of the Knox County Jail last year. It's not known when this new motion will be heard. 

Katfish...ponders has learned there are hearings scheduled for July 29 and July 30, both at 1:45 p.m. to hear these motions.

In the meantime, several media outlets including WGIL have until Monday to respond to yet another subpoena in the case asking for documentation of their coverage of the case.

The defense filed a motion for a change of venue earlier in the case and have conducted phone polls in Knox County to support their motion. That motion was argued by both sides in November 2009 and Judge Stewart denied the motion calling it premature; however, he did not preclude the defense from renewing the motion pre-trial. The defense must be keeping up-to-date on the coverage in preparation to renew the motion. 

When denying the defense motion for change of venue in November 2009, Judge Stewart said, "Knox County has an interest in this case being tried in the county in which the alleged crime is said to have been committed." 


Any readers who are fellow trial watchers know that in some states the remedy the courts have used to avoid the expense and inconvenience of moving an entire trial, yet protect  right to a fair trial of the accused, is to bring a jury in from another county within the district. Perhaps in this day and age of 24/7 media coverage more states should consider this option. Off the top of my head I know of recent cases in Tennessee and Florida that have successfully done this......I haven't researched it but I know there are other states that do the same.

A Really Good Reason Not To Break The Law In Las Vegas

After a lawyer due to defend a man against a kidnapping charge showed up to court 90 minutes late in the company of a young woman wearing a black halter top and tight pants and smelling of booze, a Clark County District Court judge ordered the attorney to take a Breathalyzer test in open court, then declared a mistrial when the test confirmed her suspicions.

Caramagno denied being drunk in an interview a few days later. He said he was in a car accident on the way to court and suffered a concussion, causing him to appear intoxicated when he was not. He said police were not called to the fender bender, so there was no record of it. "I wasn't drunk," he said. "I was ready to go forward." "I've always considered myself the consummate professional," he said. "I take all my cases very personally."

Watch these videos and you be the judge. I don't know how those people in that courtroom kept a straight face.












District Judge Michelle Leavitt did not order Caramagno into custody on a contempt of court finding; however, The LATimes reported that Wayne Blevins, executive director of the Nevada State Bar told a reporter that Joe Caramagno was representing as many as 100 cases when that incident happened. Shortly after the incident, Blevins said Caramagno "is presently in a rehab center and his current cases have been assigned to some attorneys here in Nevada and those attorneys have volunteered their time and effort to accommodate the cases as a service to the Bar."
Caramagno is well known in Las Vegas legal circles because he was one of the lawyers who helped secure the acquittal of Rick Tabish on a murder charge in 2004. Tabish and his lover, Sandy Murphy, were acquitted of charges of killing Las Vegas gaming mogul Ted Binion. They were convicted, however, of charges stemming from the theft of Binion's silver.

Even though these videos are hilarious the situation is sad. Hopefully he has got his life together so he could return to his practice.

Joshua Sheley Has 6 Hour Standoff With Police- Updated x 3

It has been brought to my attention that Joshua Sheley has been arrested again in Whiteside County, IL.

Joshua Sheley 32, of Sterling, IL was arrested on some outstanding warrants that were issued in Whiteside County on May 21, 2010. I'll get into more about the warrants and the current charges pending against Sheley in a minute.

First, I want to discuss how he and another man, Matthew Simmons, 25 were both apprehended at about 7:15 pm on Monday, July 5, while LE was searching for an attempted robbery suspect. Simmons was arrested on an outstanding Whiteside County warrant for probation violation. 

At about 12:25 pm on Monday, July 5 an attempted robbery at a local Citgo station was reported to the  Sterling police. The QC Times reports that a canine unit used during the search led police to Sheley's home at 905 2nd Ave, Sterling. Shortly after 12:30 pm on the 5th, Sterling police began knocking at the door of Josh Sheley's home, looking for him and one other possible suspect.Police say they talked with a woman with two children. She told officers no one was home, but officers could still hear someone inside. Police then obtained a search warrant and brought in the SWAT team as backup, unaware if the suspects had a gun.

Witnesses tell WQAD News 8 the police with high powered riffles surrounded the area for a block and a half. For the next four hours, police tried to communicate with Sheley and Simmons without any change. Officer eventually shot 20 to 30 rounds of tear gas through windows. Finally around 7:30pm Monday night, the SWAT team entered the house and found both men hiding huddled in a closet. Sheley and Simmons were arrested about seven hours after police first knocked on the door.

The investigation into the attempted armed robbery at the Citgo station continues. Authorities said at this point Josh Sheley does not fit the description of the suspect. So far there is no official word if Simmons fits the description; however, I did see a comment by someone who used the hat-name ignorrance and identified herself as Simmon's sister over on Topix . Part of her comment said, "matthew doesnt fit the description of the attempted robber at citgo, he is BLACK obviously the man was white or they wouldnt have even considered josh a suspect so matthew is totally out of that now when it comes to probation violation okay ignorrance on his part." I saw a news clip of the security video of the attempted robbery and the subject appeared completely covered to me, even his face. Identification will likely depend more on height, weight, and clothing....maybe voice. Even if neither man ends up charged for the robbery, it isn't clear whether there will be any charges related to the stand-off.

For those of you not familiar with Joshua Sheley, he is the older brother of Nicholas Sheley, 30,  who is charged with the deaths of 8 people  in connection with a week-long killing spree in June 2008. Nicholas S. is serving a seven-year sentence in the Pontiac State prison  for an assault he was convicted of committing against the staff of the Knox County Jail, where he was being held following his arrest in July 2008. Nicholas Sheley is expected to stand trial in Knox County sometime between February and May of 2011 for the murder of Ronald Randall,65, Galesburg, IL. If convicted he may face the death penalty.

Josh Sheley was charged with concealment of a homicide and obstruction of justice in connection with the first of the murders his brother Nicholas is charged with committing, that of Russell Reed, 93, of rural Sterling. Two other people were also charged for concealing Reed's death, the charges were dropped for one person and the other, Eric A. Smith, 30, of Rock Falls, was sentenced to 6 years in prison for hiding a gun and ammunition police say was stolen by his cousin, Nicholas Sheley, in late June 2008. Smith, pleaded guilty to one count of possession of a firearm by a felon in December 2009 and for testifying against his cousin, Joshua Sheley, a couple charges were dropped.

Hauptman stated in his controversial ruling that prosecutors proved that Joshua Sheley’s brother, Nicholas Sheley, played at least some part in the June 2008 killing of 93-year-old Reed. They also proved Joshua Sheley likely had knowledge of it, he said. But the judge said the state had not proved that Joshua Sheley took any action to cover up the crime. As frustrating as that verdict was for so many, if Joshua Sheley did indeed take action to cover-up Reed's murder, he can't be tried on those charges again, so it's left up to Karma and God to deal with him for that now. Of course, if Josh Sheley didn't take action to help his brother Nick, he shouldn't be crucified for his brother's sins either. Having said that, it appears that Joshua, like his brother, has temper and impulse control issues that can cause a lot of trouble; so it's not surprising that he has landed in jail again.

When the Sheley brothers  were arrested in July 2008, Joshua Sheley had only been out of prison for a couple months. He has managed to stay out of jail the last six months , but that doesn't mean he hasn't been (allegedly) misbehaving. The outstanding warrants he was just arrested on are 2 counts of aggravated fleeing or eluding a police officer. They are both class 3 felonies. I think the bond is $100,000.....so he needs $10,000 to bail out.
On March 19 this year Josh Sheley was ticketed for transportation or possession of alcoholic liquor in a motor vehicle. He pled guilty and was fined on April 29, 2010.  Evidently police saw Sheley driving on May 20 with a revoked drivers license, when they attempted to stop him he fled. The warrants were issued the next day, but it seems he wasn't caught until July 6 after the 6+ hour stand off. I have seen it reported in the media that the $100,000 warrant was for failure to appear for a felony, but the Whiteside County website shows the warrant being 2 counts of aggravated fleeing. ????. I  will try to find out more of the specifics.
If convicted as charged a class 3 felony is punishable by Up to a $25,000 Fine and/or 2 to 5 Years in prison for each count. My guess is some of this could end up reduced, but we still don't know if there will be charges for the stand off or attempted robbery. I wouldn't rule out either one just yet.
